  • Appellate court ruling prompts defense motions to dismiss cases

    EL CENTRO — A number of motions have been filed with the county Superior Court seeking to dismiss charges against incarcerated defendants alleging their rights to a speedy trial were violated by the pandemic-related postponement of preliminary examination hearings.

    The indeterminate number of motions were filed by defense attorneys on behalf of their respective clients and were prompted by a recent state appellate court decision that determined a Northern California trial court erred when it denied a similar motion to dismiss.
